Surrogacy in China for Australian Citizens: Citizenship, Passports and Bringing Your Baby to Australia

An increasing number of Chinese Australian intended parents are engaging in surrogacy arrangements in China and then seeking to return to Australia with their child. While the focus is often on the pregnancy and birth, many families are unprepared for the legal and immigration issues that arise afterwards.

Australian law does not prohibit Australians from engaging in surrogacy overseas in every circumstance, but the process of bringing a child home can be legally complex. Parents may need to apply for Australian citizenship by descent, an Australian passport, or visas and permanent residency for their child. In some cases, DNA testing may be required before citizenship is approved.

Australian law may not automatically recognise the intended parents as the child’s legal parents, even where they are recognised overseas. Different government departments may also apply different definitions of parentage, creating delays and uncertainty for families trying to travel home with a newborn baby.

Many surrogacy arrangements in China occur outside formal regulatory systems, meaning there may be limited documentation about the surrogate, embryo creation, donor conception, or parentage orders. This can create significant complications when dealing with Australian immigration authorities.
