By purchasing, downloading and using the Parentage Order DIY Kit or Preparation Package template digital product (the Packages, or a Package) from Surrogacy & Donor Legal Services Pty Ltd (we, us or our) via our online shop or website, you acknowledge and agree in full to the following disclaimer and terms and conditions.

1. Legal Advice

By purchasing a Package, you acknowledge and agree that the document is provided for general information and drafting purposes only. The purchase and use of a Package does not constitute legal advice, nor does it create a solicitor-client relationship between you and Surrogacy & Donor Legal Services or Sarah Jefford.

A Package is not tailored to your specific circumstances and may not address all legal requirements relevant to your situation. You must not represent or claim, either expressly or by implication, that a Package constitutes legal advice or that its purchase includes legal advice.

1. Use of Product

Upon purchase, you will be provided with access to a Package. At our discretion, we may specify a limited access time (such as 24 or 48 hours).

We grant you a non-exclusive, royalty-free, revocable licence for single use of this Parentage Order Preparation Package for your personal use only. This Package may not be copied, given to a third party, reproduced, transmitted electronically or otherwise used in any way, in whole or in part, for the purpose of commercial gain or for any purpose that may amount to competition with us in any way.

You may use a Package for your personal use only. Where permitted or intended (such as by the use of a template or checklist), you may modify the language contained in a Package or add your details. However, we do not guarantee that any modifications you make will preserve a Package’s original intent, structure or outcomes.

1. Restriction on Use by Legal Practitioners

The Packages are intended solely for use by individuals seeking to prepare their own parentage order applications. A Package must not be used by lawyers, solicitors, or other legal practitioners for the purpose of creating documents for their clients or for any commercial or professional purpose. Legal practitioners are expressly prohibited from using, adapting, or incorporating any part of a Package into documents prepared for clients or for use in their legal practice. Any such use constitutes a breach of these Terms and Conditions and may result in legal action for unauthorised use.

1. Intended Use – Simple and Uncontested Matters Only

The Packages are designed exclusively for straightforward, non-contentious parentage order applications where all parties are in agreement and there are no complex or disputed issues. A Package is not suitable for use in complex, contested, or unusual matters, including but not limited to cases involving disputes between parties, uncertainty regarding parentage, or any other circumstances that may require tailored legal advice or court intervention.

By using a Package, you acknowledge and agree that it is your responsibility to determine whether your situation is appropriate for the use of a Package, and that you will seek independent legal advice if your matter is complex, contentious, or falls outside the scope of a standard parentage order application. If you require additional assistance, legal fees may apply.

1. Prohibition on Sharing with Third Parties

You must not share, distribute, transmit, or otherwise make available a Package, or any part of it, to any third party, including but not limited to other intended parents, surrogates, or any other individuals or entities. A Package is provided for your personal use only for your own application for a parentage order and must not be copied, forwarded, or provided to others in any form, whether electronically, in print, or by any other means. Any unauthorised sharing or distribution of a Package constitutes a breach of these Terms and Conditions and may result in legal action and a claim for compensation for unauthorised use.

1. Refund Policy

While we honour the Australian Consumer Law and will refund or exchange faulty goods or services, such as where you cannot access a Package and can prove that you have been unable to access it, due to the nature of a Package being immediately accessible to you upon purchase, no refunds or credits will be issued for change of mind.

1. Intellectual Property

We retain all ownership of the copyright of a Package in its original form downloaded by you. If we see you have shared a Package with a third party or used it for commercial use rather than personal use, we reserve the right to claim compensation for such unauthorised use. This includes any visual, illustrative, or artistic content contained within a Package. Your purchase does not transfer copyright ownership in any original artwork or illustration contained in a Package, and no licence is granted to alter, reproduce, resell, distribute or publicly display such content except as expressly permitted.

1. Liability

While we use reasonable commercial endeavours to ensure that a Package is accurate and fit for download by you, we do not take any responsibility whatsoever for the suitability of a Package for your intended purpose. Further, we do not provide a warranty as to the fitness of a Package. You agree to indemnify us against all liabilities, claims, demands, damages, actions or loss arising out of your breach of this disclaimer and your use of a Package, noting we shall not be liable for any consequential, indirect or direct loss of profits, business or other damages that arise as a result of your use of a Package, regardless of foreseeability.

1. Release & Expectations

We do not make any guarantee as to the suitability of this Parentage Order Preparation Package and in purchasing a Package you acknowledge that:

(a) you understand that a Package may produce different results for different people;

(b) a Package is not tailored to your individual or business specific needs; and

(c) we do not guarantee any expected result or outcome.
