If your baby was born through surrogacy in New South Wales, the intended parents must apply to the Supreme Court of New South Wales for a Parentage Order.
A Parentage Order transfers legal parentage from the birth parents to the intended parents and allows the child’s birth certificate to be updated.
The application must comply with the requirements of the Surrogacy Act 2010 (NSW), including counselling, legal advice before the surrogacy arrangement, and consent from all parties.
